Sofia Vergara’s ex, Nick Loeb, will be allowed to sue for custody of the frozen embryos that he created with the Modern Family star when they were engaged. Nick has amended his previous lawsuit attempting to prevent Sofia from destroying the embryos and is now seeking full control.

Nick is arguing that their original contract requesting both parties consent to bring the embryos to term should be voided because it did not specify what would happen in the event of their break up. His lawyer explained, “He does believe they are his daughters.” Sofia’s lawyer responded to the new lawsuit saying, ” There is no legal issue. Embryos are not children.”

Sofia has spoken out about her drama with her ex in the press. She recently told Howard Stern that the lawsuit doesn’t make any sense and added, “a child needs a loving relationship of parents that get along, that don’t hate each other.” She also said it would be selfish to bring the embryos to term.
